An
employment agreement is any document that both the employer and employee signs
that stipulates conditions in an employment based situation. It is important to
remember that when an employment agreement is written by the employer or the
companies legal counsel it is written to protect the employers interests, not
necessarily the employees.
Common employment agreements include:
-
Employment
Contract Agreement for Employment: Typically
involves the length of time the employee is
contracted to work for the company, the position of
the employee in the company, the details of expected
services and expectations, salary or monetary
compensation of service, and grounds for termination
of the Employment Agreement.
-
Non-Compete
Agreement: Stipulates the restrictions of the
employee should the employee voluntarily leave the
company or is terminated by the company.
-
Severance
Agreement: Stipulates the restrictions of the
employee should the employee voluntarily leave the
company or is terminated by the company, any lump
sum monetary compensation, or any future residual
income or residuals to be paid by the employer.
While Employment
Agreements serve a vital service to both the employer
and employee, it is important to remember that any
employee should ensure their legal rights are protected.
Many Employment Agreements are written in a manner that
severely restrict or diminish the ability of the
employee to continue to work in his or her chosen field
of occupation.
Fortunately the employee
does have rights, and there are both State and Federal
Laws that protect those rights.

Even
if the employee signs an Employment Agreement, if the
document is written in contrast to State and Federal
Employment Laws, the agreement may be deemed void and/or
unenforceable.
It
is always wise to have experienced legal counsel review
any Employment Agreement document prior to you signing
on the dotted line. However, situations exist that a
company an individual chooses to work for will not hire
the employee unless they sign the Employment Agreement.
Merely bringing up the fact that you want an attorney to
review the Employment Agreement before you sign the
document may result in not being hired in the first
place.
It
is a double edged sword... Sign and potentially five up
certain rights... Or do not immediately sign and not get
the job.
Even
if you sign the Employment Agreement, make sure you have
a copy made for your personal employment file that you
maintain, and ask experienced legal counsel to review
your documents and Employment Agreements so that you are
fully aware of your legal rights and options should you
no longer work for a particular company in the future.
