Gender discrimination is different than Sexual Harassment, and legislated by separate State and Federal Legislation. It is actually possible for a worker to be both discriminated against because of his or her gender, while also being subjected to sexually harassment in the workplace. These are two separate violations of employment laws.

This page is dedicated to gender discrimination issues. For sexual harassment issues please go to our Sexual Harassment page of this website.

Gender discrimination, commonly referred to as Sex Discrimination is defined as treating an employee or employees differently because of their gender, affecting the "terms or conditions of employment" such as available positions within the company, promotional opportunities, pay, title, hours, vacations, and so on. This may also include whether or not a person is hired due to his or her gender (sex).

The law that governs gender or sex discrimination in the workplace and employment opportunities is Title VII of the Civil Rights Act of 1964 (last amended in 1991) and the Florida Civil Rights Act. These laws prohibit discrimination in the workplace and employment opportunities based on a worker's or applicant's gender.

While it is often easier to show gender discrimination where a worker already is employed, in situations of gender discrimination in hiring employees are typically proved as a result of a companies history in their hiring practices.

Documentation in gender discrimination cases can be extremely helpful in proving a worker is the victim of gender discrimination in the workplace. Employment records can also be evidence to show a pattern of history in gender discrimination cases.
