Sexual Harassment in the Workplace

Florida law defines workplace sexual harassment as any unwelcome sexual advances, conduct or other physical or verbal acts of a sexual nature, which occur in the workplace.

  • "Quid pro quo" - job-related benefits are offered in exchange for sexual conduct;

  • Hostile work environment - an employer maintains an overly sexual work environment, including sexually based verbal statements, however obscure they may be.

Title VII of the Civil Rights Act of 1964, last amended in 1991, affords employees the right to work in an environment free from discriminatory intimidation, ridicule, and insult, providing a clear legal standard and Federal policy against sexual harassment in the workplace.

The most common forms of Sexual Harassment include, but are not limited to:

  • Leering, i.e., staring in a sexually suggestive manner;

  • Making offensive remarks about looks, clothing, body parts;

  • Touching in a way that may make an employee feel uncomfortable, such as patting, pinching or intentional brushing against another’s body;

  • When a person, usually of authority, suggests and action of a sexual nature as a threat for termination, demotion or any other manner of affecting the victim's employment status.

If you are currently being sexually harassed, in any form, you should report each instance to your superiors and document the date, who you talked to, his or her response, and if the situation had been properly dealt with.
