First and foremost, sexual harassment in the workplace is prohibited, unlawful,
and immoral. No-one should be subjected to sexual harassment in the workplace
regardless if it is a male sexual harassing a female, a female sexual harassing
a male, or same sex sexual harassment.
Florida law defines workplace sexual harassment
as any unwelcome sexual advances, conduct
or other physical or verbal acts of a sexual nature, which occur in the
workplace.
The State of Florida does not discern between
sexual harassment for a man, woman, or same sex sexual harassment. Under the
law, sexual harassment is sexual harassment regardless of the gender of the one
being harassed, and regardless if he or she is being harassed by someone of the
other sex or same sex.
Sexual Harassment is generally considered to
include, but not limited to:
-
Direct sexual conduct - an employer makes sexual
advances or statements;
-
"Quid pro quo" - job-related benefits are offered in
exchange for sexual conduct;
-
Hostile work environment - an employer maintains an
overly sexual work environment, including sexually
based verbal statements, however obscure they may
be.
Title VII of the Civil
Rights Act of 1964, last amended in 1991,
affords employees the
right to work in an environment free from discriminatory
intimidation, ridicule, and insult, providing a clear
legal standard and Federal policy
against sexual harassment in the workplace.

sexual gestures, etc.;
-
Sending,
forwarding or soliciting sexually suggestive
letters, notes, emails, or images;

When a person, usually of
authority, suggests and action of a sexual nature in exchange for increases
of pay, better work conditions, promotions, or other

opportunities;

If you are currently being
sexually harassed, in any form, you should report each
instance to your superiors and document the date, who
you talked to, his or her response, and if the situation
had been properly dealt with. In many cases, the
employer may feel they cannot go to his or her
supervisor because the supervisor or owner is the one
committing the sexual harassment. We urge you to still
document everything and make some attempt to calmly let
the supervisor know that you feel uncomfortable by the
actions that have occurred.
Documenting what you have
been forced to endure may be extremely beneficial if it
is necessary to bring litigation against the employer
and/or other employees and supervisors.
