Workplace - Employment Retaliation Claims

Jacksonville Workplace Retaliation Attorney - Lawyer, providing experienced Employment - Workplace Retaliation, Labor Law, and Employment Law legal Services in Jacksonville, Hilliard, Duval County, Nassau County and the surrounding Northeast Florida areas.

It is unlawful for an employer to retaliate against an employee in any way regarding complaints made to proper labor organization agencies, or any legal claims which are filed by the employee as a result of workplace actions or conditions.

The Equal Employment Opportunity Commission (EEOC) contains anti-retaliation provisions that stipulate it unlawful to discriminate against an individual because he or she has opposed any practice made unlawful under the employment discrimination statutes. This protection applies if an individual explicitly or implicitly communicates to his or her employer or other covered entity a belief that its activity constitutes a form of employment discrimination that is covered by any of the statutes enforced by the EEOC.

Even so, some employers often believe they are smarter than the law. They may try to make the workplace a difficult place to be in order to get your to quit. These sometimes suttle changes in the way a company treats you are still a violation of the Equal Employment Opportunity Commission (EEOC) anti-retaliation provisions.

There are essentially three elements of a workplace retaliation claim:

  • Opposition to discrimination or participation;

  • Adverse action;

  • Causal connection between the protected activity and the adverse action.

Workplace retaliation often takes the form of:

  • Sudden or a progression of reducing the scheduled hours that the employee is to work;

  • Untimely demotion of the employee;

  • Termination or Discharge of the Employee;

  • Reduction in pay;

  • An employee being re-assigned to a department which the employee is unfamiliar, essentially setting them up to fail, making their termination viable;

  • Sudden poor performance reviews, following a history of positive and productive performance reviews;

  • Denying an employee the proper resources, which were previously available, to properly perform their job duties at a level of expectation or time constraints;

  • Exclusion from advancement or pay increases as others less qualified, experienced, or in seniority are advanced or given pay increases instead.

Essentially, if you notice any changes in the working conditions, your hours worked, reduced responsibilities, reassignments, reduced support and resources that diminish your ability to perform at an optimal level... these may all be signs of retaliation in the workplace. It is also not uncommon for an employer to promote the employee to a position the employer knows the employee is not ready to handle for the sole purpose of justifying the employee's termination.

We urge any employee to keep an employee file for his or herself to document their work history, performance reviews, any changes that affect your ability to perform your duties, verbal conversations that affect you, you job, and position within the company (good or bad). You should even document rumors that are spread that get back to you, as it is not beneath some employers to start rumors and let other employers do the dirty work for them.

As an employee, you should protect your rights and ensure that if anything affects you, you have documented as much as possible. Documentation is often what turns the tables in your favor in any employment dispute, including workplace retaliation claims.
